The Florida Building Code requires the "New educational facilities for school boards and Florida college boards, unless specifically exempted by the board with the written concurrence of the applicable local emergency management agency or the Florida Division of Emergency Management (DEM), shall have appropriate areas designed as enhanced hurricane protection areas (EHPAs)..."

Based on coordination with Brevard County Emergency Management, portions of the new middle school would be used to shelter law enforcement and other public sector employees who are now using Viera High School. This will allow Viera High School to be used for an overflow EHPA shelter for the public if needed.

An exemption is needed because the middle school does not need to be designed to meet all EHPA criteria, but will be designed for shelter capabilities in specific buildings in partnership with Brevard County Emergency Management. The attached letter outlines the framework for the middle school design relative to emergency management. This is a lower cost option while still meeting the emergency management needs.

This approach has been coordinated with Brevard County Emergency Management and the District's Building Official.

Board action is required to exempt the proposed Viera Area Middle School from compliance with EHPA design standards in the Florida Building Code because not all EHPA criteria will be met.

Based on the written concurrence of Brevard County Emergency Management (attached), exempt the new Viera Area Middle School from the enhanced hurricane protection area design requirements in the Florida Building Code Section 453.25.1 New Facilities.
