Wharton Smith, Inc. (Wharton) submitted a Guaranteed Maximum Price (GMP) in an amount not to exceed $3,428,238 under the contract awarded November 19, 2019 (RFP 20-147-P-DR) for construction management services for Challenger 7, Columbia and McAuliffe Elementary Schools. The design was prepared by TLC Engineering Solutions under their continuing contract for mechanical, electrical, plumbing and fire protection engineering (MEP) services. 

After the project at Columbia Elementary was substantially complete, the school started to experience problems with high humidity in the kitchen.  The original project scope did not include work to the kitchen ventilation system.  Investigative work was completed and the proposed change order will address several issues that are causing the humidity in the kitchen.  The proposed work includes a new kitchen fan that is properly sized along with associated ductwork, duct heater, supply air diffusers, and a motorized outside air damper.  All of this equipment will be connected to the building automation system controls which can be managed from our centralized plant operations center.  Other work will include electrical, door seals, thermostat controls, along with test and balance work when the job is completed.  The proposed change order #1 for additional construction management services is for $68,548.41.  The project will be funded through any remaining sales surtax funds allocated to the Columbia project, supplemented by capital if needed.

Board approval is required for change orders in cumulative excess of 10% of the contract value or cumulative amount of $50,000. The proposed change order exceeds $50,000.  The standard agreement template has been used which does not require legal review. 

Recommendation

Approve owner-directed change order #1 in the amount of $68,548.41 to the construction management services contract with Wharton Smith, Inc. for additional kitchen ventilation system upgrades at Columbia Elementary School.
