Brevard County collects educational facilities impact fees from residential development for construction of educational facilities or capital improvements that provide educational capacity in the Impact Fee Benefit District from which the funds were collected. The process is governed by Brevard County Code of Ordinances, Chapter 62, Article V, Division 7 Educational Facilities - Sections 62-922 - 62-935. The Code allows for incentives "to promote the construction of new housing that is affordable to lower income households."

Saint Stephen's Way, Inc., a Florida not-for-profit corporation is proposing to build an affordable rental housing apartment complex to provide housing for homeless families with children attending Brevard County Schools, located near Lipscomb Street and Brothers Avenue in the City of Melbourne. The project will include 40 residential units, all of which will be reserved for families with students enrolled in Brevard Public Schools and with a gross annual income that does not exceed 80% of the area median income. 

Brevard County Board of County Commissioners approved the Educational Facilities Impact Fee Deferral Contract for the St. Stephens Way Affordable Housing Development at its May 23, 2023 meeting. Based on the Deferral Contract, the educational facilities impact fees ($77,620) are deferred, with a lien recorded on the property. If the property is sold or no longer being used in accordance with the terms of the Contract the educational impact fees become due and payable. If the developer fulls the terms of the Deferral Contract for ten years, the lien will be extinguished.

Brevard County has requested School Board consideration of the Deferral Contract as the Board utilizes educational facilities impact fees for building new educational capacity. The staff concurs with the terms of the Deferral Contract as the document stipulates that the housing units are solely for families with children already attending Brevard Public Schools; therefore, no additional capacity would be needed for these students.  

Recommendation

Approve and authorize the Chairman to execute the Educational Facilities Impact Fee Deferral Contract for the St. Stephens Way Affordable Housing Development
