The purpose of the proposed new policy is to ensure compliance with all applicable federal and state laws, Florida State Board of Education Rules, Board policies, administrative rules, procedures, and guidelines. In addition, the proposed new policy promotes transparency and accountability.

• This is a new policy being proposed in light of changes to federal law.
• The federal Department of Education issued historic and sweeping regulations governing the implementation of Title IX, with particular emphasis on specific due process procedures mandated in cases of sexual harassment that occurs in the scope of education programs and activities.
• The proposed new policy encompasses the suggested language from NEOLA that closely follows the extensive procedures and obligations required under the Title IX federal regulations, effective August 14, 2020.
• The specific definitions presented herein are required by the federal regulations in 34 C.F.R. Part 106.

Recommendation

Board Policy 2266 - Non-Discrimination on the Basis of Sex is a proposed new policy and will appear before the School Board on the dates indicated below:
