The US Army Corps of Engineers (Corps) notified District that a portion of the Sea Park Elementary Schol site "may be within or near the former Naval Air Station Banana River Off-Base Disposal Area, a Formerly Used Defense Site (FUDS). The Corps is "responsible for evaluating, and if necessary, remediating, environmental impacts from the Off-Base Disposal Area. The Corps awarded a contract to "begin the Remedial Investigation/Feasibility Study to determine the nature (what) and extent (where) of impacts attributable to the Navy's disposal activities in the 1940's." The Corps requires permission of property owners to access potentially affected properties to investigate and potentially remediate. 

The Corps uses a standard Right of Entry form and will not modify the terms of the Right of Entry for any property owner. However, the Corps was receptive to our concerns and has provided a response letter that indicates they will work closely with the District team to avoid any impacts to the operation of Sea Park Elementary. Most importantly, they have agreed that all project work will be performed when students are not present. The Corps team has been very cooperative in working with the District team to identify and address all issues, including the District's General Counsel and Risk Manager. The District's lead point of contact during the investigation phase will through our Environmental Health, Safety and Code Compliance Team.

Staff is recommending that the Board authorize the Chair to execute the Right of Entry form.

Recommendation

Authorize the Chair to execute the US Army Corps of Engineers Right of Entry for Environmental Assessment and Response on the Sea Park Elementary School campus.
