The School Board owns approximately 10.19 acres of property including a closed school, located in Titusville along South Street (County Road 405) and Lane Avenue, referred to as Whispering Hills.  The school was built in 1959 as Whispering Hills Primary School (grades K-3).  According to our Finance Department, the cost center for Whispering Hills Primary School was closed in 2006 and the school was repurposed as Whispering Hills Education Center.   For a few years, Whispering Hills Education Center was used as an adult education center, alternative school, and abeyance center.  After years of deferred maintenance, most of the school was condemned for educational uses and the areas still safe to use were repurposed as offices.  Brevard Schools has not had any uses in the facility for about 5 years. 

The Educational Plant Survey, approved by the School Board on 12/12/2017 and submitted to the Florida Department of Education, states that the Whispering Hills Education Center facility/site is no longer required for instructional or ancillary purposes and will be offered for sale.  At the August 10, 2021 School Board Meeting, the School Board adopted Resolution 2022-03 declaring the Whispering Hills Education Center facility unnecessary or unsuitable for educational or ancillary purposes and facilitating the disposal of the property.

The property has been advertised for sale through the District's real estate broker since October 2021 with an asking price of $1,900,000.

The real estate broker has received multiple offers on the property.  The offers are contingent upon a due diligence period to determine if the property is suitable for the buyer's intended use.  This will likely involve Comprehensive Plan changes and zoning changes through the City of Titusville.  As the owner, the School District will need to sign the application(s) for any land use or zoning changes. The broker's commission is 4.25% which will be paid from the proceeds of the sale. At the time when this agenda was written, staff was reviewing the offers and determining the best course of action.  This agenda item recommends approval of one contract and potentially approval of back up contracts. PLEASE NOTE THAT THIS AGENDA ITEM WILL BE UPDATED PRIOR TO THE BOARD MEETING.

Staff recommends allocation of the net proceeds of the sale towards the future acquisition and construction project that will relocate the Satellite bus facility and the Mid-South transportation/maintenance facility (referred to as "Central Area Transportation/Maintenance Facility" in the Five-Year District Facilities Work Program). 

Recommendation

Authorize the Superintendent, or designee, to execute the contract for the sale of the Whispering Hills Education Center property, contingent upon a due diligence period to determine if the property is suitable for the buyer's intended use.

Authorize the Superintendent, or designee, to execute backup contracts for the sale of the Whispering Hills Education Center property, contingent upon a due diligence period to determine if the property is suitable for the buyer's intended use.

Authorize the Superintendent, or designee, to sign any necessary documents, which the Buyer may be required to file with local government offices in connection with any land use or zoning changes necessary for the buyer's intended use of the property during the due diligence period.
