Per the Florida Department of Education (FLDOE) requirement, local school boards must develop and submit a written statement of policies and procedures for providing an appropriate program of specifically designed instruction and related services for students with disabilities.

The ESE policies and procedures (SP&P) for the school years 2018-2019 through 2020-2021 was approved on February 12, 2019. However, the FLDOE requested changes to the 2019-2020 SP&P. Timelines for these changes are listed below.

For the school years 2019-2020 through 2021-2022, the following changes were made to the ESE policies and procedures (SP&P) document:

•             The following sections required districts to review and/or provide the required information:

  • Part I Section A.2: Legal Requirements Related to the Use of Restraint and Seclusion
  • Part I Section A.3: Requirements Related to Documenting and Reporting Incidents of Restraint and Seclusion
  • Part I Section A.4: District Procedures Related to Documenting and Reporting Incidents of Restraint and Seclusion
  • Part I Section A.6: District Plan Related to Reducing the Use of Restraint
  • Part I Section A.7: District Plan Related to Reducing the Use of Seclusion
  • Part I Section C.1: Exceptional Student Education Procedural Safeguards
  • Part II Section C: Individual Educational Plan
  • Part II Section E: Participation in State and District Assessments
  • Part V Appendix C: District Plan to Increase the Participation of Underrepresented Students in the Program for Students who are Gifted
  • Part V Appendix D: District Policies Regarding the Allowable Use or Prohibition of Physical Restraint and Seclusion
  • Part V Appendix F: Best Practices in Inclusive Education (BPIE) Assessment

•             The following section was added by the FLDOE:

  • Part V Appendix G: District Procedures During a Declared State of Emergency

Timelines for submission of SP&P to FLDOE:

  • 05/04/2020         Document release to school districts by FLDOE
  • 06/22/2020         Brevard SP&P submitted to FLDOE for approval
  • 06/30/2020         FLDOE requests revision to Part I, Section A.6
  • 06/30/2020         FLDOE requests revision to Part V, Appendix F
  • 06/30/2020         Revision to Part V, Appendix F submitted
  • 07/06/2020         Revision to Part I, Section A.6 submitted
  • 07/07/2020         Brevard’s SP&P is pre-approved by FLDOE
Recommendation

Approve the new Exceptional Student Education Policies and Procedures (SP&P), effective 2019-2020 through 2021-2022 for the final submission to the Florida Department of Education.
